Medical Negligence claims are extremely complicated, expensive and stressful. You therefore need the right firm of attorneys who have the financial muscle and are big and powerful enough to take on the teams of lawyers retained by the medical defence union and / or insurers of negligent doctors and hospitals. Beware of pretenders i.e. very small firms of attorneys who advertise about their "team" of lawyers and about their "in house medical advisors" but who may in fact be a one person practice assisted by a couple of unqualified clerks and a junior attorney or two. You need to ask for proof in writing as to how many qualified lawyers actually exist in such firms and how many of them are specialists in medical negligence claims. Insist on seeing a certificate issued by the Supreme court of South Africa certifying that the person responsible for your claim is an admitted attorney. If your claim is dealt with by a candidate attorney, insist on seeing the contract of articles stamped by the Law Society. Do not permit any other person to deal with your claim, because such person is neither an attorney nor a recognized professional, is not legally permitted to charge you fees and should not be entrusted with such important work.
